The gears look ok other than they have been sitting for a while. I would leave them alone for now and keep them for a spare in the future. Make sure the ratio is the same and realize that you will no longer have a locked front end since your spare is open.
Sounds like you can either keep your brakes as they are or bite the bullet and replace the drums. That sucks.

So I can't just replace the big gear and leave the weld?

How will you get the big gear off without cutting the weld?
Typically ring and pinion sets are matched pairs and most people would suggest not mixing them but in this case I think an exception could be made but I really do not think it is worth the trouble.
Also, you will have the set the backlash again so you might as well replace all of it together and install a locker or weld it up.
In my opinion, you should just leave it be and spend your time and money on the other pressing items.
Don't leave that spare diff open to the elements if it is going to continue to be your spare. Either take it out and protect it or seal it back up.

you can change the ring gear without removing the welds...

OK do you think its worth changing that ring gear? I will get the bearing and seal for the one side I need it on and try adjusting the brakes out. He did put a couple turns on the one so I will try that. Its just hard for me to do things half ass. But right now I will go for this this. Just hate to get in to that other D44 for the ring gear. But that might make it las longer. I had to get away from it for awhile. Yall chime in I want to hear more advice before I get back after it in the morning.

I ran broken ring gear for two years. Or chipped ring gear. It will probably be ok. Run it like it is.

I was going to offer you a "project" D44 I've got collecting dust here, but it sounds like you already have one...
